Attorney General Jeff Sessions' new stance would allow federal prosecutors in states with marijuana programs to decide how aggressively to enforce federal laws. Session's memo repeals that Obama-era policy.

A total of five businesses are licensed to cultivate, manufacture and sell marijuana products for medicinal purposes in New York, according to the New York Medical Cannabis Industry Association. Scott's spokeswoman, Lauren Horwood, said he declined to comment on the most recent federal move.

Gardner, who was in the Fort Collins area touring local businesses Friday, said he felt misled by Sessions on federal marijuana policy and that Sessions' decision Thursday to rescind the so-called Cole memo took him by surprise.

"Strong as we are on state's rights here in Texas", Williams said.

The memo refers to the 1970 Controlled Substances Act, where cannabis is classified as a drug in the same category as heroin.

California Lieutenant Governor Gavin Newsom, a Democrat, said his state will pursue "all legal, legislative and political options to protect its reforms and its rights as a state".

"That would be his top priority, and that is regardless of what the topic is, whether it's marijuana or whether it's immigration", Sanders told reporters.

The former senior Justice Department official behind the decision to harmonize federal prosecutions with state legalization efforts during the Obama told CNN in a phone interview Thursday that it's uncertain how Sessions' new memo will play out at the state level. She did not elaborate.

"If they close down regulated access to cannabis, all they are doing is opening it up to the cartels and the black market", he said.

U.S. Sen. Catherine Cortez Masto, a Democrat, derided as "hypocrisy" the policy change from a presidential administration that she accused of "trampling on the will of Nevadans and creating unnecessary confusion for our state".

"In deciding which marijuana activities to prosecute under these laws with the Department's finite resources, prosecutors should follow the well established principles that govern all federal prosecutors", Sessions said.

The appointment of interim U.S. Attorney Dayle Elieson was announced Wednesday.

Former Republican Maryland state delegate Don Murphy, who now works in conservative outreach for the Marijuana Policy Project, said the AG's move, presumably sanctioned by Trump, is odd considering the populist wave in favor of decriminalizing marijuana across the country-not only in blue states, but places like Arkansas, the first Bible Belt state to legalize medical marijuana, and with 53 percent of the vote.

Patrick McCarthy, spokesman for the NY cannabis association, sidestepped a question on how revocation of the Obama-era memos would affect medical marijuana providers, practitioners and patients. The new uncertainty about how prosecutors will deal with this will only make it harder. But Arcview's leader, Troy Dayton, said the industry was resilient.
