Markey: Democrats will Restore 60-Vote Threshold for Supreme Court

CBS News chief White House correspondent Major Garrett and CBS News justice correspondent Jan Crawford discuss the impact Justice Neil Gorsuch wi...

In Gorsuch, Trump picked a respected federal appeals court judge who is seen as a fervent disciple of Scalia and a brand of conservative jurisprudence that calls for the strict interpretation of the US Constitution as its writers intended.

The swearing-in ceremony of the 49-year-old justice was held in the Rose Garden of the White House, during which U.S. President Donald Trump lauded the accomplishment of his hand picked candidate.

Trump said: "Justice Gorsuch, you are now entrusted with the sacred duty of defending our Constitution". Gorsuch will be the first former Supreme Court law clerk to serve alongside his onetime mentor.

On Thursday, Senate Majority Leader Mitch McConnell triggered a legislative manoeuvre known as the "nuclear option" when Republicans lacked the 60 votes required to end debate on Mr Gorsuch. If at least four justices agree, a case can be accepted and added, at this point in the year, to the court's oral argument docket for the term that starts next October.

In perhaps the most notorious opinion of his judicial career, the so-called "frozen trucker" case, Gorsuch dissented against a majority decision supporting the right of a truck driver, caught in an unexpected blizzard, to disconnect his load and drive his rig to shelter. He said his now-confirmed nominee to the court will render his judgments "not on his personal preferences but based on a fair and objective reading of the law".

Gorsuch's first case on the court will be a high -profile religious-rights case concerning a Missouri law banning churches from getting public funds for aiding people.

Attorney Douglas Ross also told Bloomberg that Gorsuch's appointment to the court will be "a very good thing for the development of antitrust law", due to his history as an antitrust lawyer. All but two of the men were white.

For instance, in 2015, John Roberts, Samuel Alito and Anthony Kennedy each interrupted Elena Kagan and Sonia Sotomayor 10 or more times-meaning in total, each woman endured more than 30 interruptions.

Gorsuch is different in other ways.

Markey mentioned how Trump had promised during the presidential campaign that anyone he nominated to the Court would be anti-abortion and pro-gun rights, what the senator described as litmus tests. He and his family attend an Episcopal church in Boulder, Colorado, though he was raised Roman Catholic and attended Catholic schools as a child.

A few hours after the swearing-in ceremony, a Pennsylvania college honored Scalia and Ginsburg with its annual award for civility in public life.

In her remarks accepting the award, Ginsburg said collegiality "really matters" at the court and urged members of Congress to "lead in restoring harmonious work ways".
